Privacy Notice - Housing and Economic Land Availability Assessment (HELAA)

Please read the following Privacy Notice carefully.

Why we are collecting your data

Basildon Borough Council needs to collect your personal data so that the Council can to identify future sources of land for housing and economic development to help meet the Borough's future development needs.

  • Telephone number
  • Email address
  • Signature.

The personal data you provide on this form will be used for the purposes of contacting you in respect of the HELAA, Brownfield Register, the Local Plan, Joint Strategic Plans and/or any other plans, guidance or strategies which concern the development or use of land within the Basildon Borough.

The basis for the processing

We are legally required to process this data by the Planning & Compulsory Purchase Act 2004 and as guided by the National Planning Policy Framework (NPPF) and Planning Practice Guidance (PPG).

If you chose to provide your data for this purpose, or ask us to erase your data, you will not be able to have land you are promoting for development included in the HELAA, which could affect the prospects of it being developed in the future. 

Who your information will be shared with

We will not share your personal data unless required to for the purpose of the prevention or detection of fraud or crime.

Information submitted using this form will form part of the evidence base to the emerging Local Plans, Joint Strategic Plans and any other plans, guidance or strategies which concern the development or use of land within the Basildon Borough therefore, with the exception of personal data, the information provided will be made available to the public, primarily by being published on the Council's website.

Providing accurate information

We need to hold accurate and up to date information about you so that we can deliver appropriate services. If any of your details change, you need to tell us as soon as possible so that we can update your records.

We will not:

  • Use your information for marketing or sales purposes without your prior explicit consent
  • Send or store your data abroad unless it meets the requirements of the Data Protection regulations
  • Make decisions about you based on automated processing.
     

How long will we hold your data for?

Your data will be used for up to five years. We will contact you annually to confirm if you wish to remain on the HELAA and that your details are correct. Your data will deleted one year after it has ceased to be used.

Your rights

You have the right to access the personal information we hold about you.  Any access requests are free of charge.
If the information we hold about you is inaccurate, you have a right to have this corrected and you have the right to request completion of incomplete data.
You have the right to ask us to erase your personal data in certain circumstances ('right to be forgotten').

You have the right to ask us to stop or restrict the processing of your personal data, in certain circumstances.  Where possible, we will seek to comply with your request, but we may need to hold or process information to comply with a legal requirement.
