Licensing - Applications for a Designated Premises Supervisor (DPS) exemption

If the need for a DPS is dis-applied and your premises becomes exempt from the need to appoint a DPS then, in its capacity as the premises licence holder, the premises committee or management board will become collectively responsible for making sure the premises follows the law and complies with the licensing objectives.

If there is a licensing offence, we can prosecute the committee or management board.

If someone hires the premises, they will be responsible for matters falling within their control under the contract for hire.

If a hirer commits a licensing offence, it is unlikely that we will prosecute the committee or management board.  However, the committee or board will need to prove that they gave the hirer a written summary of their responsibilities when selling alcohol.

Application forms

The forms to make an application for the need for a Designated Premises Supervisor to be dis-applied are only available from the GOV.UK website which gives guidance on the application procedure including  payment of application fees.

PLEASE NOTE:

• There is an application fee of £23.00 payable when the application is submitted
• If we do not grant the  Designated Premises Supervisor (DPS) exemption, we will not refund your fee

Once we receive your application we will:

• Acknowledge it within three working days
• Notify you of the outcome
