Town and County Planning Act 1990 - Appeal under Section 78 - Appeal by Orwell (Basildon) Limited - Land at Market Square, Basildon, Essex

The Planning Inspector is seeking views regarding an appeal made on the grounds of non-determination of the above planning application.

Proposed Development: demolition and redevelopment of the existing building and erection of a mixed use scheme comprising of flexible commercial floorspace (Use Class A1-A5, B1, D1 and/or D2) on the ground-first floors and 492 one and two bedroom residential apartments (use Class C3) in three blocks of up to 17 storeys, with associated parking, servicing and communal amenity areas.

Council reference: 20/00955/FULL.

An appeal has been made to the Secretary of State on the grounds of non-determination of the planning application within the appropriate period of time. The appeal will be determined on the basis of an Inquiry. The procedure to be followed is set out in the Town and Country Planning Appeals (Determination by Inspectors) (Inquiry Procedure) (England) Rules 2000, as amended.
